"Kamu Hukukunun Temelleri, kamu hukuku disiplininin tarihsel süreç içerisindeki oluşumuna (onun temel özelliğini ve özgün işlevini belirtik kılarak) ışık tutuyor. Yazar kamu hukukunu, ortaçağ temel hukuk düşüncesinin sekülerleşmesinin, rasyonelleşmesinin ve pozitif bir hüviyet kazanmasının ardından varlık bulan bir hukuk türü olarak ele alıyor. Kamu hukukunun, modern devleti doğuran değişimlerin bir sonucu olarak oluştuğunu, böylelikle de modern yönetim anlayışına yetke ve meşruiyet kazandırdığını savunuyor. Loughlin, konuya geniş bir perspektiften bakarak, hukukun, devlet erkini sınırlamaktan çok, onun (yeniden) üretilmesini sağlayan bir araç olarak anlaşılması gerektiğini ileri sürüyor.
