"Aile" ve" çocuk" hukuku günümüz modern hukukunun hem en önemli hem de oldukça sorunlu bir konu olmaya devam etmektedir. Her iki ana konu beraberinde aile içi şiddet, her tür istismar, velayet, miras, mal rejimi gibi birçok suç ve haksız fiil ile de ilişkili olabilecek hukuksal sorun kaynaklarıyla ilişkilidir. Ülkemizde de gelişmiş ülkelerde de özellikle çocukların cinsel istismarı, evlilik birliğine karşı işlenen suçlar, çocuğun üstün menfaatinin ihlal edilmesi, ensest, çocuk pornografisi gibi ciddi ve güncel sorunlar, genelde aile hukuku kurallarını özelde bireyin temel haklarını ciddi biçimde ihlal eden eylemlerdir. Bu kitapta, evlilik kurumu ve evlilik kurumu ile bağlantılı alt başlıklar ile özellikle çocuğun üstün menfaati, çocuğun katılım hakkı ve çocukların hakları ile Aile hukukundan kaynaklı temel hak ve sorunlar, hukukun önemli her dalı bakımdan ele alınmaktadır. Slovenya ve Türkiye'den konunun uzmanı hukukçular, mevzuat, yargı içtihatları ve öğreti ışığında her iki ülke hukuku açısından bu alanlara ilişkin temel alt konuları incelemişlerdir. Kitapta araştırma konularının orijinal metinleri yanında, Türkçe ve İngilizce özetlerine de yer verilerek, her iki ülke hukukçularının bu karşılaştırmalı hukuk eserinden yararlanması hedeflenmiştir. -- Arka kapak. |
