Bu çalışmamızda öncelikle terörizm kavramı temel hatlarıyla ele alınmaktadır. Terörizm, Efesli filozof Heraklitos'un meşhur "her şey değişir, değişmeyen tek şey değişimdir" sözünü doğrularcasına çağlar içerisinde birtakım değişikliklerden geçerek bugünkü halini almış, geldiği noktada ise ulus aşan özelliği bulunan yabancı terörist savaşçı kavramını kendi kapsamından çıkarmıştır. Terörizmi etkisiz kılma adına yürütülecek mücadelede çeşitli yöntemler benimsenebilir. Sınırları aşan ve birden fazla devleti ilgilendiren bir problem söz konusu olduğu için devletlerin birlikte hareket etmeleri gerekmektedir. Bu birlikteliğin tek bir çatı altında yürütülmesi elzemdir ve bu noktada öne çıkan kuruluş ise bütün dünya devletlerini ortak zeminde bir araya getirme özelliğini haiz olan Birleşmiş Milletler'dir. Yabancı terörist savaşçı meselesine yönelik Birleşmiş Milletler'in almış olduğu kararların yanı sıra, devletlerin kendi mevzuatlarında gerçekleştirmiş oldukları değişikliklere de bu çalışmada yer verilmektedir. Tezin amacı, Birleşmiş Milletler'in yabancı terörist savaşçılarla mücadeledeki rolünün ve bu rol yerine getirilirken verilen katkı ve zorlukların incelenmesidir. |

In this study, the term terrorism is reviewed fundamentally. The term terrorism, as it validates the famous saying of the Ephesian philosopher Heraclitus, "everything changes, the only constant in life is change" takes its form today, passing through particular changes and at some point takes the foreign terrorist fighter phenomenon which has transnational characteristic out of its scope. Several methods could be adopted while countering terrorism. As the issue at hand is about a transnational problem which concerns more than one country, the states must act together. This collaboration can efficiently be realized under one single roof. This roof is provided by none other than the United Nations, who has the ability of gathering all nations worldwide. Apart from the steps and measures that have been taken by the United Nations towards foreign terrorist fighters, the legal steps that are taken by the states are also adressed in this study. The aim of this study is to analyze the role and contributions of the UN in the fight against foreign terrorist fighters, and the challenges it faces. |
