Bilgi ve iletişim teknolojilerindeki gelişmeler, dijital çalışma platformlarının yükselişine zemin hazırlamıştır. Dijital çalışma platformları geçtiğimiz on yılda, hizmet talebini görece pratik ve ucuz yoldan karşılama yöntemi olarak kendine sağlam bir yer edinmiştir. Aslında yeni teknolojilerin kullanılıyor olmasına rağmen dijital çalışma platformlarında sunulan hizmetlerin büyük bir kısmı temelde yeni değildir ve geleneksel iş piyasasında yürütülmeye devam etmektedir. Bu durum, özellikle de en yaygın hizmetleri yolcu taşıma ve teslimat olan konum tabanlı dijital çalışma platformları için geçerlidir. Dijital platform çalışmasının yeni olan tarafı, gelişmiş teknolojiden yararlanılması ve platformların kendilerini işveren değil, yürütülen işin aracısı olarak tanımlamasıdır. Bu çalışma modeli, iş görmede kullanılan araçlar ve işin yürütümü ile ilgili risk ve maliyetleri çalışanlara kaydırıp platformun katlanarak büyümesini sağlamaktadır. Ayrıca, kaliteli müşteri deneyimi sunmak isteyen dijital platformlar, otomatik denetim ve karar alma sistemleri aracılığıyla çalışanlar üzerinde geleneksel olarak işverene ait olan yönetim yetkilerini kullanmaktadır. Dijital platformlar, büyük miktarda veri ve bilgiyi kontrol ederek çalışanlarını gitgide daha fazla kendilerine bağımlı hale getirirken platform çalışanları güvencesiz istihdamın bütün sonuçlarına katlanmaktadır. Bu çalışma kapsamında işbu yeni çalışma modelinin ortaya çıkarttığı sorunlar ve bunlara yönelik çözüm önerileri detaylı olarak tartışılmıştır. Platform çalışmasıyla ilgili olarak karşılaştırmalı hukukta yer alan düzenlemeler ve özel girişimler kapsamlı şekilde incelenerek konuyla ilgili çıkarımlarımız ve önerilerimize ayrıca yer verilmiştir. |

Developments in information and communications technology have formed the foundations for the rise of digital labour platforms. In the last decade, by providing a practical and cheaper way compared to traditional way of providing services, digital labour platforms secured their places in the market. Although they are using new technologies, majority of the tasks and services which are available on digital labour platforms cannot considered new as they are still performed simultaneously in traditional labour markets. This is especially the case for location-based platforms, where taxi and delivery services are the most prevalent tasks they offer to their customers. The new aspect of the digital labour platforms is their self- identification as the intermediary between the customer and the 'provider', not the employers of platform workers. This working model enables the platform to grow exponentially by shifting the risks and costs related to the tools used in doing business and the execution of the business to the workers. In addition, digital platforms that want to provide quality customer experience use management powers that traditionally belong to the employer over employees through automatic control and decision-making systems. While digital platforms control large amounts of data and information, making their workers increasingly dependent on them, platform workers suffer all the consequences of precarious employment. Within the scope of this study, the problems caused by this new working model and the solution suggestions for them are discussed in detail. Regarding the platform work, regulations and private initiatives in comparative law have been examined comprehensively whereas personal conclusions and suggestions are included as well. |
