Beraat hükmü, ceza muhakemesine sanık olarak dahil olmuş herkesin ulaşmak istediği ve bu hükmün verilmesi için çaba gösterdiği, bu hüküm uğruna deliller ortaya koyup savunmalar yaptığı bir hüküm çeşididir. Sanığın gerçekleştirdiği eylemin suç niteliği barındırmadığı ya da sanığın o eylemi gerçekleştirmediği veya gerçekleştirdiği hususunun kesin olmadığı yargısını barındıran beraat hükmü sayesinde sanık aklanmış olur ve kendisi hakkında herhangi bir yaptırım uygulanmaz. Cezalandırılmasına engel olan diğer hüküm çeşitleri de bulunmasına rağmen beraat hükmü sanık için en lehe olan hükümdür. Beraat hükmü birçok ilke ve kuralla iç içedir. Özellikle suçsuzluk karinesi ve lekelenmeme hakkının tam anlamıyla uygulanması, beraat hükmü için çok önemlidir. Suçun sanık tarafından işlendiğinin sabit olmaması nedeniyle verilen beraat kararı ise şüpheden sanık yararlanır ilkesi ile yakından ilişkilidir. Bu ilke sayesinde hâkim veya mahkeme nezdinde suçu işlediğine vicdanen yüzde yüz kanaat getirilemeyen kişi mahkûmiyet hükmü ile karşılaşmayacaktır. Bu kural, bir suçlunun cezasız kalmasının bir masumun cezalandırılmasına tercih edilmesinden kaynaklanmış ve gelişmiştir. Beraat kararı; hukuk yargılamasını, idare hukukunu ve vergi hukukunu etkileyebileceği gibi bir başka ceza mahkemesi nezdinde de etkili olabilir. Bu nedenle verilen beraat kararının bu mahkeme ve merciler üzerindeki etkisi büyük önem taşır. |

An acquittal judgment is a type of decision that every individual involved in criminal proceedings as a defendant strives to obtain, making efforts and presenting evidence and defenses in pursuit of this outcome. Through an acquittal, the defendant is exonerated due to the determination that either the act does not constitute a crime, did not commit the act, or it is not certain that the defendant committed the act. Although there are other types of judgments that prevent punishment, acquittal is the most favorable decision for the defendant. The acquittal judgment is closely intertwined with many principles and rules. In particular, the full application of the presumption of innocence and the right to be protected from stigmatization has a critical importance. A decision of acquittal rendered due to insufficient evidence proving the defendant's guilt is closely related to the principle of in dubio pro reo. That principle, ensures that no one is convicted unless their guilt is proven with absolute certainty. This rule reflects the idea that sparing the innocent outweighs punishing the guilty. Furthermore, an acquittal judgment may also have effects beyond the scope of criminal law, such as in civil law, administrative law, or tax law, and may influence proceedings before another criminal court. Therefore, the impact of an acquittal decision on other courts and authorities is of great significance. |
