Araştırma, banka teminat mektuplarının işlevi, ödeme talepleri süreçleri ve milletlerarası unsur içeren banka teminat mektuplarına uygulanacak hukukun tespiti ile ilgili uluslararası düzenlemeler üzerindeki etkilerini analiz etmek amacıyla literatür taraması ve hukuki belge incelemesi yöntemleriyle gerçekleştirilmiştir. Çalışmada, uluslararası ticarette banka teminat mektuplarının güvence sağlama ve ödeme taleplerinin nasıl işlediği açıklığa kavuşturulmuş, ilgili yasal düzenlemelerin uygulamadaki etkileri tartışılmıştır. Tez, banka teminat mektuplarının hukuki yapısı, ödeme talepleri süreçlerinin düzenlenmesi ve milletlerarası unsur içermesi halinde taraflar arası anlaşmazlıkların çözümü konularında literatüre katkı sunmayı hedeflemektedir. Birinci bölümde, banka teminat mektubunun tanımı, türleri ve genel işleyişi ve teminat mektubunda ödeme taleplerinin hukuki boyutları ve son olarak ikinci bölümde milletlerarası unsur içeren banka teminat mektuplarına uygulanacak hukuk ve uluslararası düzenlemeler incelenmiştir.

The research was conducted using literature review and legal document analysis methods, with the aim of analyzing the function of bank guarantees, the payment request processes, and the effects of international regulations on determining the applicable law for bank guarantees involving international elements. The study clarifies how bank guarantees provide security in international trade and how payment requests operate, while also discussing the impact of relevant legal regulations in practice. The thesis aims to contribute to the literature on the legal structure of bank guarantees, the regulation of payment request processes, and the resolution of disputes between parties in cases involving international elements. The first section addresses the definition, types, and general functioning of bank guarantees, and discusses the legal aspects of payment requests in bank guarantees. Finally, the second section examines the applicable law and international regulations for bank guarantees involving international elements.
